Perlindungan Hak-Hak Buruh dalam Perspektif Hukum Ketenagakerjaan di Indonesia: Kajian terhadap Upah, Jam Kerja, dan Cuti

Penelitian ini berfokus pada analisis terhadap pengaturan hukum ketenagakerjaan di Indonesia dalam menjamin perlindungan hak-hak pekerja, khususnya terkait pengupahan, pengaturan waktu kerja, hak atas cuti, serta perlindungan bagi pekerja perempuan dan anak, sekaligus mengkaji implementasinya berdasarkan prinsip keadilan, kemanfaatan, dan kepastian hukum. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan komparatif. Bahan hukum yang dianalisis terdiri atas bahan hukum primer berupa peraturan perundang-undangan, bahan hukum sekunder dari literatur akademik dan jurnal ilmiah, serta bahan hukum tersier sebagai pendukung. Hasil penelitian menunjukkan bahwa secara normatif, sistem hukum ketenagakerjaan di Indonesia telah menyediakan kerangka perlindungan yang cukup memadai bagi pekerja. Namun demikian, dalam praktik masih terdapat berbagai permasalahan, seperti ketidaksesuaian penerapan upah minimum, pelanggaran terhadap ketentuan jam kerja, serta belum optimalnya pemenuhan hak cuti dan perlindungan bagi pekerja perempuan dan anak. Selain itu, perkembangan teknologi digital dan perubahan pola hubungan kerja turut menimbulkan tantangan baru, khususnya dalam sektor ekonomi digital yang belum sepenuhnya diakomodasi dalam regulasi yang ada. Ditinjau dari perspektif filsafat hukum, kondisi tersebut menunjukkan bahwa perlindungan hak pekerja belum sepenuhnya mencerminkan keseimbangan antara keadilan, kemanfaatan, dan kepastian hukum. Oleh karena itu, diperlukan penguatan regulasi, peningkatan efektivitas penegakan hukum, serta penyesuaian kebijakan ketenagakerjaan yang lebih adaptif guna mewujudkan perlindungan pekerja yang berkeadilan dan berkelanjutan
